An appeals court in Pennsylvania has ruled that nursing homes can be help corporately liable for injuries caused by negligent care of elders that result in abuse lawsuits.
The Pennsylvania Superior Court overturned a ruling against a nursing home that stated that they were not liable for the death of one of their residents in 2004 after she had a heart attack after suffering from untreated bed sores, dehydration, malnutrition and a urinary tract infection.
The lawsuit was filed by her son and he claimed that the nursing home was understaffed and this caused the death of his mother. The court ruled against him at first and then the Superior Court determined that the company was responsible for compensation and other punitive damages.
